What is a clean break order?
A clean break order is a financial order that prevents either spouse from making any future financial claim against the other. It is the strongest form of financial separation and is usually preferred where neither party needs ongoing support.
How are pensions split in divorce?
Pensions can be shared (pension sharing order), offset against other assets (pension offsetting), or earmarked for future payment (pension attachment). Pension sharing is the most common and creates a clean break.
Do I have to disclose all my finances?
Yes. Full and frank financial disclosure is a legal duty when negotiating a settlement. Hiding assets can result in any agreement being set aside, and in serious cases, contempt of court proceedings.
